1. About These Terms

These Terms of Service (the “Terms”) govern your use of nlmattress.ca and purchases from Northern Lights Mattress Company (“Northern Lights”, “we”, “us”, or “our”). Northern Lights operates in Ontario, Canada.

By using this website or placing an order, you agree to these Terms and the policies referenced below. Nothing in these Terms is intended to limit rights or remedies that cannot legally be excluded under applicable consumer protection legislation.

2. Products and Order Information

We aim to provide fair and accurate information about each product, including its model, selected size, package or options, price, applicable taxes, delivery or shipping method and charges, payment method, and applicable policies. Customers can review and correct their order information before completing checkout.

Orders remain subject to acceptance and availability. We may contact you to resolve an obvious pricing or input error, an unavailable selection, a delivery limitation, or suspected fraudulent activity. If a paid order cannot be accepted or fulfilled, we will provide an appropriate refund or other remedy consistent with applicable law and our published policies.

3. Pricing and Payment

Prices are in Canadian dollars unless otherwise indicated. Applicable taxes and delivery or shipping charges are disclosed during the ordering process. Accepted payment methods are those displayed at checkout.

For Interac e-Transfer, an order remains unpaid until Northern Lights has received and verified the transfer. Submitting an order or transfer confirmation does not itself prove payment. Production or manufacturer ordering will not begin until payment has been verified.

4. Delivery

Delivery and shipping are governed by our Shipping & Delivery Policy. Delivery and production times are estimates unless we expressly guarantee a specific date. Nothing in these Terms limits statutory rights relating to substantially late delivery or non-delivery.

5. Returns and Exchanges

Returns, comfort exchanges, fees, replacement value, eligibility, and related review requirements are governed by our Returns & Exchanges Policy. These Terms do not create different or additional return restrictions.

6. Warranty

Mattress care information and the process for manufacturer-backed warranty claims are described in our Care & Warranty information. Warranty coverage varies by product and source. These Terms do not create a new manufacturer warranty or limit rights that cannot lawfully be excluded.

7. Website Use

You must not misuse the website, interfere with its operation or security, submit fraudulent information or orders, impersonate another person, or unlawfully copy protected website content. You may use the website and its content for lawful personal shopping purposes.

8. Privacy

Personal information is handled in accordance with our Privacy Policy. Payment information is handled through the payment options and platforms presented during checkout.

9. Errors and Availability

We may correct obvious typographical, product, pricing, availability, or order-entry errors and contact you where necessary. We will not use an error correction to avoid appropriate refund obligations or mandatory customer rights for a legitimate paid order.

10. Ontario and Canadian Law

These Terms are governed by the applicable laws of Ontario and Canada. Nothing in these Terms is intended to exclude, restrict, or waive any right or remedy that cannot legally be excluded under applicable consumer protection legislation. These Terms do not require mandatory arbitration or impose an exclusive court venue.

11. Changes to These Terms

We may update these website Terms prospectively by publishing a revised version and changing the “Last updated” date. Where appropriate, the Terms and policies in effect when an order is placed will govern that transaction. A later website update will not retroactively rewrite an accepted customer agreement.
